Terms and Conditions of Service
I Live Where You Vacation
Servicios de Geolocalización ASAFP, S.A.P.I. de C.V.
These Terms and Conditions of Service govern the use of tourism-related services provided by Servicios de Geolocalización ASAFP, S.A.P.I. de C.V. (hereinafter “I Live Where You Vacation”), with registered address at Calle Pucte Mz 16 Lote 4-01, SM 311, Colonia Alfredo V. Bonfil, Cancún, Benito Juárez, Quintana Roo, C.P. 77560, Mexico.
By booking any of our yacht charters, villa rentals, tours or other tourism services, the client (hereinafter, the “User”) accepts and agrees to these Terms and Conditions of Service.
1. Reservations and deposits
- To confirm any reservation, a deposit of 30% of the total service value is required.
- The remaining balance (70%) must be settled on the day of the service, prior to commencement.
- Deposits may be made through the payment methods available on our platform, including certified external gateways (e.g. Stripe, Cover Manager).
2. Cancellation and refund policy
- Cancellations made 15 calendar days or more prior to the reserved date: 100% refund of the deposit, less applicable banking fees.
- Cancellations made between 10 and 14 calendar days prior: 80% refund of the deposit, less applicable banking fees.
- Cancellations made between 5 and 9 calendar days prior: 30% refund of the deposit, less applicable banking fees.
- Cancellations made with less than 5 calendar days’ notice: no refund will be granted.
- Refunds will be processed using the same payment method as originally used by the User, with banking or gateway commissions deducted as applicable.
3. No show
If the User fails to attend on the scheduled date and time of the contracted service (no show), no refund will be issued, and the deposit will be forfeited in full.
4. Changes to reservations
- Changes to the date, time or type of service may be requested up to 5 calendar days prior to the original reservation, free of charge, and are subject to availability and applicable tariffs at the time of rebooking.
- If the requested change cannot be made, the reservation will be deemed a no show, and the corresponding policy will apply.
5. Force majeure and special conditions
- Yacht charters: if the Port Authority orders closure due to adverse weather, the User will receive a 100% refund of the deposit.
- Villa rentals: refunds or rescheduling will only apply in cases of natural disasters, subject to availability and potential tariff adjustments.
- In all cases of force majeure, I Live Where You Vacation will make reasonable efforts to reschedule the service at the nearest available date.
6. Additional services
- Additional services such as chef, DJ, decorations, transport, barbecue, photography and videography must be confirmed at least 5 calendar days in advance.
- These services require a 50% deposit, which will be non-refundable in the event of cancellation.
7. User obligations
- The User agrees to provide truthful information at the time of booking, including full name, official identification or passport, and contact details.
- The User shall be responsible for the conduct of all guests during the provision of the service, as well as for any damages caused to yachts, villas or facilities.
8. Limitation of liability
I Live Where You Vacation shall not be liable for delays, modifications or cancellations resulting from:
- Weather conditions, port closures, natural disasters or other force majeure events.
- Restrictions or orders imposed by competent authorities.
- Misconduct, negligence or omissions attributable to the User or their guests.
9. Jurisdiction and governing law
These Terms are governed by the laws of the United Mexican States. For the interpretation and enforcement of these Terms, the parties submit to the jurisdiction of the competent courts of Cancún, Quintana Roo, Mexico, expressly waiving any other jurisdiction that may correspond by reason of their present or future domicile.
